Terms of Service

Mooi Huis Cleaning Services — Windwijzer 9, 4336 KX Middelburg — KvK: 96650249

Article 1 – Definitions

  • Contractor: Mooi Huis Cleaning Services, established in Middelburg.
  • Client: any natural person (consumer) or legal entity that commissions work to be carried out.
  • Consumer: a Client who does not act in the exercise of a profession or business.
  • Services: cleaning services, window cleaning, facade cleaning, solar panel cleaning and related services.
  • Subscription: periodic service provision based on a fixed frequency.

Article 2 – Applicability

These terms and conditions apply to all quotations, agreements and services.

Deviations are only valid if agreed upon in writing.

General (purchasing) terms and conditions of the Client are expressly rejected.

Article 3 – Quotations and Formation of Agreement

Quotations are non-binding and valid for 30 days, unless stated otherwise.

An agreement is concluded upon written confirmation or upon commencement of the services.

Additional work will be charged separately.

Obvious errors or mistakes in quotations are not binding on the Contractor.

Article 4 – Performance of Services

Services are performed to the best of the Contractor's knowledge and craftsmanship.

The Client is responsible for ensuring:

  • Free access to the property
  • Availability of water and electricity
  • Safe working conditions in accordance with applicable legislation

If services cannot be performed due to circumstances on the part of the Client, the Contractor is entitled to charge call-out costs and reserved labour time.

Article 5 – Window Cleaning and Working at Heights

Glass and facade components must be safely accessible.

If the use of a cherry picker, scaffolding or additional safety provisions is required, these costs will be invoiced separately unless otherwise agreed.

Services may be postponed in unsafe situations or extreme weather conditions.

The Client is responsible for the structural condition of window frames, sealant, paintwork and glass.

The Contractor is not liable for damage resulting from deferred maintenance.

Article 6 – Subscriptions (Periodic Service Provision)

Subscriptions are entered into for a minimum duration of 6 or 12 months.

Upon expiry of the minimum term, the subscription is tacitly renewed for an indefinite period.

After renewal, the subscription may be cancelled on a monthly basis with a notice period of 1 month.

Cancellation must be made in writing or by email.

Rates may be indexed annually.

Article 7 – Prices and Payment

All prices are exclusive of VAT, unless stated otherwise.

Payment must be made within 14 days of the invoice date.

Upon exceeding the payment term, the Client is in default by operation of law.

For consumers:

  • In the event of late payment, the Consumer will first receive a free 14-day reminder notice in accordance with the Dutch Extrajudicial Collection Costs Act (WIK).
  • Collection costs are calculated in accordance with the statutory scale.

For business clients:

  • Statutory commercial interest and collection costs are immediately due.

In the event of payment arrears, the Contractor is entitled to suspend services.

Article 8 – Direct Debit

If agreed, the Client grants written authorisation for direct debit.

In the event of a chargeback, the payment obligation remains in force.

Administrative costs may be charged.

Article 9 – Right of Withdrawal (Consumers)

For agreements concluded at a distance or outside the business premises, the Consumer has a 14-day cooling-off period.

If the Consumer requests commencement within this period and the service has been fully performed, the right of withdrawal lapses.

If partially performed within the cooling-off period, a proportional fee is due.

Article 10 – Liability

The Contractor is solely liable for direct damage resulting from demonstrable negligence.

Liability is limited to the invoice amount of the relevant assignment or the amount paid out by the liability insurance.

This limitation does not apply in cases of intent or gross negligence.

The Contractor is not liable for:

  • Scratching of already damaged glass
  • Hairline cracks or thermal fractures
  • Damage due to poor condition of sealant or window frames
  • Hidden defects

Article 11 – Complaints

Complaints must be reported in writing within 48 hours of completion of the services.

The Contractor will be given the opportunity to resolve the complaint within a reasonable period of time.

Article 12 – Force Majeure

Force majeure is understood to mean all circumstances beyond the Contractor's sphere of influence, including weather conditions, illness, government measures and material shortages.

In the event of force majeure, the performance of services is suspended without liability for damages.

Article 13 – Applicable Law and Disputes

Dutch law applies to all agreements.

Disputes will be submitted to the competent court in accordance with statutory provisions.

Quotation Terms

  • Quotations are based on available information.
  • Additional work will be treated as extra work and charged separately.
  • Rates are exclusive of VAT unless stated otherwise.
  • Price changes due to cost increases or indexation will be communicated in a timely manner.
  • Subscriptions are subject to a minimum term of 6 or 12 months.
  • After the minimum term, cancellable on a monthly basis with 1 month's notice.
